NY Court Of Appeals To Hear Yeshivah Education Case
By Idy Perl
The case regarding yeshivah education has been in and out of
court over the last few years as religious parents fight for religious liberty
in private schools.
In 2022 the State Education Department made new regulations
for yeshivah education, which were challenged by PEARLS (Parents for
Educational And Religious Liberty in Schools). A hearing in March concluded
that parts of the regulation were illegal and struck them down.
The State appealed the verdict, and a panel of the Appellate
Division of the Supreme Court of NY reversed it and reinstated the regulations.
The NY Court of Appeals remained the last hope to strike
down those regulations once again. Although the Court Of Appeals hears only
very few of the cases that come to the court, PEARLS filed a motion with them
to challenge the Appellate Division’s verdict.
Earlier today the motion was granted, and the Court of
Appeals will likely hear the case at the beginning of 2025, giving PEARLS
another chance to fight for yeshivah education.
